The Court of Appeal has, in a unanimous decision delivered today, upheld an appeal filed by Hon. Ken Ohene Agyapong in his legal dispute with seasoned journalist Kweku Baako.

The appeal challenged an earlier judgment of the Accra High Court, which had ruled in favour of Kweku Baako after striking out portions of the defendant’s witness statements at the Case Management Conference (CMC) stage. Hon. Ken Agyapong contended that the High Court’s decision was flawed and warranted appellate review.

In its ruling, the Court of Appeal set aside the High Court’s judgment and ordered a retrial of the case, effectively reopening the matter for fresh proceedings. The appellate court further directed that all monies paid pursuant to the High Court’s decision be refunded to Hon. Agyapong within thirty (30) days.

The decision marks a significant development in the protracted legal battle between the two public figures, with the case now expected to return to the High Court for a full rehearing on its merits.
